Hit and run accidents in California, or leaving the scene of an accident, are characterized by any failure of a driver who is knowingly involved in any kind of collision with a vehicle or pedestrian, whether there is a visible injury or not, and then leaves the scene of the accident.

Leaving the scene of an accident prior to producing the necessary driver documentation is considered Hit and Run and may carry criminal charges. You must stop whether the accident involves a pedestrian, a moving car, a parked car, or someone's property. If you drive away, even if the accident wasn't your fault, you can be charged with the crime of Hit and Run.

Not all "hit and run" accidents involve a car collision. There are times when the driver of one car will swerve dangerously or otherwise make a movement which causes another driver to react, triggering an accident which does not involve the first car. The first driver usually is unaware that his conduct has caused a car accident. There are many police reports in which the blame for the car accident is attributed, at least in part, to a "phantom vehicle."
